Terms of Service

Important Notice: AI-Assisted Grading

AI grading is provided as an assistive tool only. All grading results generated by the Agoge Platform are preliminary suggestions and must be reviewed by the instructor before release to students. Agoge Development LLC does not guarantee the accuracy, completeness, or fairness of AI-generated grades. Instructors are solely responsible for all final grade determinations.

1. Acceptance of Terms

By accessing or using the Agoge Platform ("Service," "Platform") operated by Agoge Development LLC ("Agoge," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Platform on behalf of an educational institution or organization, you represent that you have authority to bind that organization to these Terms.

If you do not agree to these Terms, you may not access or use the Platform. We may update these Terms from time to time; continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.

The Agoge Platform is an AI-powered teaching toolkit designed for higher education. The Platform provides tools including, but not limited to:

3. User Accounts and Responsibilities

3.1 Account Creation

Access to the Platform requires an account created via invitation from an authorized administrator. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Instructors using AI-assisted grading features are responsible for reviewing all AI-generated feedback and grades before communicating results to students. The Platform is a tool to support your professional judgment, not to replace it.

4. Data Handling

4.1 What We Collect

We collect account information, assignment submissions uploaded for grading, grading results, and usage data necessary to operate the Platform. For full details, please review our Privacy Policy.

4.2 Third-Party AI Providers

When AI-assisted grading features are used, submission content is transmitted to third-party AI providers (including Anthropic and OpenAI) for processing. By using these features, you consent to this data transfer. Student personally identifiable information (PII) is stripped from submissions before transmission where technically feasible. For environments requiring fully on-premise AI processing, the Platform supports local AI runtimes (e.g., Ollama).

4.3 FERPA

We operate in alignment with the Family Educational Rights and Privacy Act (FERPA). We act as a "school official" with a legitimate educational interest when processing student records on behalf of an institution, and we do not sell student data. Institutions remain responsible for ensuring their use of the Platform complies with FERPA and applicable institutional policies.

5. AI-Generated Content Disclaimer

The Platform uses artificial intelligence to assist with grading, feedback generation, and content creation. AI-generated outputs:

6. Intellectual Property

6.1 Your Content

You retain full ownership of all content you upload to the Platform, including course materials, rubrics, assignment submissions, and grading configurations. By uploading content, you grant Agoge a limited, non-exclusive license to process that content solely for the purpose of providing the Service to you.

6.2 Platform and Software

The Agoge Platform, including its software, design, and documentation, is the exclusive property of Agoge Development LLC and is protected by copyright and other intellectual property laws. Nothing in these Terms transfers any ownership rights in the Platform to you.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AGOGE DEVELOPMENT LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF REVENUE, OR HARM TO ACADEMIC STANDING, ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM.

The Platform is a teaching aid designed to assist instructors. It is not a substitute for professional academic judgment. Agoge Development LLC is not responsible for grading decisions, academic outcomes, or any consequences thereof.

In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability is limited to the fullest extent permitted by law.

8. No Warranty

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Given that the Platform is in active development (Early Access Beta), features may change, be temporarily unavailable, or behave unexpectedly. We will make reasonable efforts to communicate significant changes.

9. Termination

We reserve the right to suspend or terminate your access to the Platform at any time for violation of these Terms, non-payment of applicable fees, or for any other reason with or without notice. You may discontinue use of the Platform at any time by contacting your account administrator.

Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.

10. Governing Law

These Terms are governed by the laws of the State of Michigan, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved in the courts of Michigan.
